The landscape of AI governance in the United States is at a pivotal juncture. Recent federal initiatives propose a decade-long moratorium on state-level AI regulations, aiming to establish a unified national framework. However, this move has encountered significant resistance from states advocating for their right to implement localized AI policies tailored to their constituents’ needs.

Texas stands at the forefront of this pushback. The state’s legislature has passed the Texas Responsible AI Governance Act (TRAIGA), which awaits Governor Greg Abbott’s signature. This comprehensive bill seeks to regulate government use of AI, prohibit social scoring systems, and restrict the use of AI in identifying individuals through publicly available images. Additionally, it addresses concerns over AI-generated deepfakes and mandates transparency in governmental AI systems.

The federal proposal, embedded within a broader tax bill, suggests tying compliance to federal broadband funding, effectively penalizing states that pursue independent AI regulations.
